I am grateful to receive a lot of comments and likes on the article I wrote last year about credit card defaulters like me facing the same issue with credit card debt collectors in the Philippines. Since then, I am receiving questions from them and left unanswered because of busy schedule. I apologize. But now is the time that I have more time to answer all your enquiries. Yes, today I will start writing more about your credit card debt problems and how you can resolve it.
For today, let us discussed the problem of my reader named Travis:
“i have a question cause i have a credit card debt.. somebody told me that you should never run or hide with these people because if you do its a criminal case for them because your intentionally not paying your debt.. im just renting a apartment, and im always changing places, my previous place in manila is they’re always hunting me (the debt collector) my previous room mates said that everyday they keep on calling, im so afraid when one day thay said that 2 police came on that place.. pls help me on this, and also one time i talk to the debt collector and they offer me a monthly plan and it is way too high for me, thats the reason why i move to another place..”
Travis and I experienced the same thing, being paranoid about resolving our credit card problems, but thanks to a blogger named banker, now I know the truth behind this and I will tell you. No! You will not be imprisoned by defaulting your credit card. Here in the Philippines, as per our bill of rights article 3 section 20:
No person shall be imprisoned for debt or non-payment of a poll tax.
Regarding the police that chased Travis, it is intentionally done by credit card debt agencies to scare people like us. Don’t believe them. You may want to call the NBI to report about this and can file an extortion case against their police officials who clearly appeared as an accomplice by your credit card debt collectors.
Travis also asked:
"hi clickmarbin just wanna say thank you cause right now i am so freaking out and so afraid to go back to manila because of it.. umm what about my NBI clearance? cause i saw lot of stories that many people didnt get cleared for their NBI because of this case, meaning to say that if we have a civil case we never get a chance to work to another company or work abroad.. right now im working as a call center in ortigas and i was planning to work to another or abroad but because of this issue (NBI CLEARANCE) im having a hard time to resign"
Since non payment of credit cards is not a criminal case but only a civil case in the Philippines, you can get an NBI clearance. Our NBI only handles criminal case and not civil cases like defaulting credit cards.
